Covid-19 Update

Dear Valued Clients,

In this ever-changing landscape, Johnson, Murrell & Associates, PC is here to assist you. As an essential business we have remained open while instituting measures recommended by the World Health Organization (WHO), the United States Centers for Disease Control and Prevention (CDC), and the State of Tennessee. As our state moves to the phase of fully re-opening our economy, we will continue to be open to serve the needs of our clients and our community. We are open our regular business hours of Monday-Friday from 8.30 AM to 5 PM. In order to continue implementing social distancing, our office will remain open By Appointment Only and we will utilize teleconference over in-person meetings except where absolutely necessary. This will continue through Friday, 15 May 2020.

As part of serving our clients, there are a few items from trusted sources we would like to share with you.

1. From First American Title Insurance regarding the tolling of Statute of Limitations:

To Our Tennessee Agents,

In late March, First American distributed communication NA-2020-008 that addressed the possible tolling of statutes of limitations during the COVID-19 pandemic. Please also see below a copy of the Order issued by our Tennessee Supreme Court on April 24, 2020. Your attention is specifically directed to paragraph 7 on page 3, highlighted in pertinent part. This paragraph extends until June 5, 2020 any statute of limitations that would have otherwise expired between March 13, 2020 and May 30, 2020.

This extension applies to deeds of trust maturities, judgment liens, mechanics and materialman liens and state tax liens… as well as litigation appeal periods. In addition, this extension also applies to estate situations, including the period within which claims must be filed, and those situations where you may be waiting for 5 months after the date of death in which to disburse funds. If your creditor filing period would have otherwise expired between March 13, 2020 and May 31, 2020, it has been extended until June 5. Likewise, if the date of death occurred between September 13, 2019 and November 30, 2019, the 6 month period will not expire until June 5, 2020.

2. From the Tennessee Supreme Court regarding in-person Hearings:

The Supreme Court has extended the Judicial Emergency to May 31, 2020. In the new Order (linked and posted below), the Court has allowed Judicial Districts to submit plans for more in-person hearings.
